RAES PHARMACEUTICAL LOGISTICS NV considers Your privacy important.  We are committed to safeguarding and protecting Your right to privacy and data protection in accordance with the policies set out below.  This document sets out the specific conditions regarding the processing of Your Personal Data.  The application of the privacy policy defined below is governed by Belgian law.  The courts territorially competent for the registered office of RAES PHARMACEUTICAL LOGISTICS shall have exclusive jurisdiction in the event of any dispute.

This privacy policy document does not stipulate anything about the processing of Personal Data by Third Parties.

1 – Definitions

• “Personal Data” refers to any information relating to an identified or identifiable natural person (the “Data Subject”).  An identifiable person is a natural person who can be identified, directly or indirectly, in particular by means of an identifier such as a name, an identification number, location data, an online identifier, or one or more elements characterizing physical, physiological, genetic, psychological, economic, cultural or social identity.
• “You” refers to a Data Subject in his/her capacity as a visitor to our Website.
• “Controller” refers to RAES PHARMACEUTICAL LOGISTICS, a company incorporated under Belgian law, with registered office at Moerstraat 48-50, 9031 Drongen, and with company number 0525.781.372 – info@raeslogistics.com – T +32 (0)9 280 744 (hereinafter “RAES PHARMACEUTICAL LOGISTICS” or “We”).
• “Processor” refers to a natural or legal person, public authority, agency, or other body that processes Your Personal Data on behalf of RAES PHARMACEUTICAL LOGISTICS.
• “Website” refers to our site https://www.raeslogistics.com/.
• “Third Party” refers to a natural or legal person, a public authority, an agency or any other body, other than the Data Subject, nor RAES PHARMACEUTICAL LOGISTICS, nor its Processors, nor the persons authorised under the direct authority of RAES PHARMACEUTICAL LOGISTICS or its Processors to process Personal Data.  The processing of Personal Data by Third Parties will be set out in the applicable privacy policy of that Third Party.

2 – Which Personal Data

RAES PHARMACEUTICAL LOGISTICS aims to process the minimum amount of Personal Data necessary for the exercise of its activities. In this regard, we may process, inter alia, the following general Personal Data:

• “Personal identification data” which can refer to, among other things: Name, title, address (private, work), past addresses where applicable and e-mail addresses, telephone or mobile number (private, work).
• “Identification date, other than national register number, issued by the government” which can refer to among other things: Identity card number, passport number.
• “Electronic identification data” which can refer to, among other things: IP addresses, cookies, connection moments, tracking pixels, tags, scripts.
• “Electronic localisation data” which may refer to: Mobile phone, GPS.
• “Financial Data” which can refer to, among other things: Bank details and bank account numbers.
• “Personal characteristics” which can refer to, among other things: Gender, date of birth, place of birth, marital status, nationality.
• “Data made available” which can refer to, among other things: Data published on or available on e.g. Your profile on social media that is publicly accessible. Details of references and Emergency Contacts. Information that You forward or hand over to us.

3 – Purpose of processing and legal basis

The Personal Data collected will be used in carrying out the activities, including:

• Customer management, i.e. everything to do with customer administration, service management, execution and invoicing of services, monitoring payments and solvency.
• Supplier management, i.e. everything to do with supplier administration.  Management of enquiries, payment of Suppliers, prospecting of potential Suppliers and their evaluation.
• Merger/acquisition, i.e. anything to do with the transfer of Personal Data in the context of a merger with or an acquisition of all or part of the assets by another company.
• Fight against fraud and infringements, i.e. everything relating to activities aimed at preventing and detecting such acts.
• Security, i.e. everything to do with the processing of Personal Data to ensure the safety of persons or goods, the safety and/or proper technical functioning of the IT network system, the Website, apps and products at least to ensure the (physical) protection of the company and all this with a view to the continuity of services.
• Management of disputes and litigation, i.e. everything to do with managing one’s own disputes and litigation, complying with court or arbitration orders, in the context of legal proceedings, exercising one’s own rights, defending against legal claims, complying with contractual and statutory obligations, monitoring equal opportunities, and defending against discrimination claims, providing information to prevent offences.
• Website management, i.e. everything to do with the general management of the Website with the aim of making it available and accessible to visitors.
• Networking, i.e. everything to do with networking events, social events, happenings, fairs, …
• Acting in emergency situations, i.e. everything to do with contacting the specified persons in the event of an emergency.
• Public relations, i.e. everything related to personalised marketing and advertising, business development, market research and statistical analysis within the scope of individual services and for internal use only.
• Technical-commercial information, in particular anything related to the analysis of competitors and possible business partners.
• Direct marketing, i.e. anything to do with prospecting, activities, services offered by commercial companies, charities or other associations or foundations, including those of a political nature, to population segments. The means of communication used for this purpose may be e-mail, telephone, or other direct means (e.g. e-mail, …).  It does not matter whether the addressee is already a customer or not.

Such Personal Data shall only be processed insofar as such processing is lawful.  In this regard, the processing of Your Personal Data is essentially necessary for the proper performance of the contracts entered into with You or to take measures at Your request prior to the conclusion of a contract.  The processing may also be necessary if a legal obligation incumbent on RAES PHARMACEUTICAL LOGISTICS must be complied with whereby reference may be made, inter alia, to the legal obligations concerning tax law and social law.  Furthermore, RAES PHARMACEUTICAL LOGISTICS may also be subject to obligations in the context of judicial or extrajudicial disputes, by law enforcement agencies, public authorities, etc.  Occasionally, the processing of your Personal Data will be carried out to protect Your vital interests or those of another natural person.  In addition, processing may sometimes be carried out for legitimate interests on the part of RAES PHARMACEUTICAL LOGISTICS.  If you make use of the Website, RAES PHARMACEUTICAL LOGISTICS may use certain Personal Data for purposes which support the Website and the services provided by RAES PHARMACEUTICAL LOGISTICS or which result in improved functionality.  Finally, if the applicable legislation requires that the processing of certain Personal Data requires Your consent, You will naturally be requested to do so.  If such consent is given, You may withdraw it at any time.  To do so, You will send a notification to info@raeslogistics.com indicating that You have withdrawn Your consent.  In that case, Your Personal Data will no longer be processed for the purposes for which Your consent was originally granted, unless another legal basis leads to doing so.

4 – Transfer of Personal Data

Your Personal Data shall be processed by the employees, agent and appointees of RAES PHARMACEUTICAL LOGISTICS; In doing so, it shall be ensured that only such Personal Data as are necessary for the performance of the assignment shall be processed. However, Your Personal Data may be shared with the following categories of recipients, among others, if the legal conditions are met:

• Your personal relationships.
• Your professional advisers.
• Your employer or business partner.
• Individuals or organisations in a contractual relationship with RAES PHARMACEUTICAL LOGISTICS.
• Postal, transport and other delivery companies to better send our mail.
• Other (private) companies.
• Administrations.
• Social security authorities.
• Court, arbitration and law enforcement agencies.
• Banks and insurance companies.
• Affiliated and associated companies of RAES PHARMACEUTICAL LOGISTICS.

We may share Your Personal Data with Processors.  This includes, for example:

• IT service providers.
• Companies doing credit checks and background checks.
• Payment processing and software companies.
• Banks and insurance companies.
• ….

These Processors are appointed by RAES PHARMACEUTICAL LOGISTICS and are therefore also authorised to process Your Personal Data to the extent necessary for our services.  In doing so, however, the Processors must take into account the instructions and privacy policy of RAES PHARMACEUTICAL LOGISTICS.

RAES PHARMACEUTICAL LOGISTICS may need to share your Personal Data with judicial or arbitration authorities or law enforcement agencies when, for example:

• Have to comply with court orders or legal proceedings.
• Want to exercise/enforce our rights.
• Need to defend ourselves against legal claims.
• Are invited to do so by law enforcement agencies.

Outside the European Union, Personal Data will only be transferred if the recipient complies with Personal Data Protection legislation and if the method of transfer provides adequate protection.  These protections include, inter alia, contractual provisions, the EU-US Privacy Shield or the European Commission’s assessment that the country in question has an adequate level of Personal Data Protection.  For certain parts of our business, Your Personal Data may be stored in the ‘cloud’.  We recall that countries outside the European Economic Area may not offer the same data protection as Belgium. The present privacy policy remains in any case applicable to all Personal Data we process.

5 – Personal Data protection

RAES PHARMACEUTICAL LOGISTICS attaches great importance to the protection of Your Personal Data.  We have therefore taken measures to ensure that Your Personal Data is not misused and unauthorised persons cannot access it.  This includes measures in case of a suspected data breach or Personal Data breach.  If You believe that Your Personal Data has been misused, lost or accessed by unauthorised persons, please notify RAES PHARMACEUTICAL LOGISTICS immediately by email to info@raeslogistics.com.

Your Personal Data is held on servers hosted by RAES PHARMACEUTICAL LOGISTICS or by its internet service provider.  Data transmission over the internet is never completely secure.  We do our best to protect Your Personal Data but cannot guarantee the security of the Personal Data You transmit via the Website.  Any such transmission is at Your own risk.

6 - Retention of Personal Data

RAES PHARMACEUTICAL LOGISTICS does not keep Your Personal Data for longer than necessary. For those Data Subjects with whom we maintain a contractual relationship, we will keep Your Personal Data for a period of at least 10 years.  Thereafter, Your Personal Data will be deleted except in those cases where RAES PHARMACEUTICAL LOGISTICS needs to maintain Personal Data in order to comply with its legal obligations, resolve disputes or enforce our agreements.  If You would like more information about our data retention policy, please contact us at info@raeslogistics.com. 

7 - Your rights in relation to Your Personal Data

You have certain rights in relation to Your Personal Data.  For example, within applicable legal provisions, You have the right to request that we:

• Provide You with information about and access to the Personal Data we hold about You.
• Correct Your Personal Data which is incorrect or no longer up to date.
• Deleting Your Personal Data.
• Limit the processing of Your Personal Data.
• Transfer Your Personal Data to a third-party service provider specified by You.
• Provide You with one copy of the Personal Data we process about You.
• Consider Your legitimate objections regarding our use of Your Personal Data.

In addition, You may also oppose any processing of Your Personal Data if such opposition is based on legally foreseen grounds.  In that regard, we inform You that You may oppose any processing of Your Personal Data at any time:

• Because of specific special reasons, in particular insofar as the processing is based on the legal ground “public-interest task” or “balancing of legitimate interests”, including profiling carried out on these grounds.  The processing will then cease, unless compelling, justified and overriding grounds on our behalf must be withheld or insofar as the reasons for the processing relate to the establishment, exercise, or substantiation of legal claims.
• In case of direct marketing including profiling for direct marketing purposes.
• For the purpose of scientific or historical research or statistical purposes unless the processing is necessary for the performance of a task carried out in the public interest.
• For the purpose of individual automated decision-making such as profiling which has legal consequences for You or which otherwise significantly affects You. 

RAES PHARMACEUTICAL LOGISTICS will investigate and respond to all requests in this regard. It is possible that, for this purpose, RAES PHARMACEUTICAL LOGISTICS will ask You to provide her with certain data so that You can verify Your identity before answering Your request.  Certain Personal Data are exempt from such request under certain circumstances.  If an exemption applies, RAES PHARMACEUTICAL LOGISTICS will inform You of this in its response to Your request.  This response will be provided to You within 1 month of the request being made.  Depending on the complexity of the requests and the numbers of requests, this deadline may be extended by 2 months if necessary.

All complaints relating to the processing of Personal Data received by RAES PHARMACEUTICAL LOGISTICS are taken very seriously.  If You believe that we are processing Your Personal Data in a manner that is unlawful, improper and insufficiently transparent, please notify us.  If You wish to complain about this policy or the procedure contained in it, please contact us by sending an email to info@raeslogistics.com. Within the EU, You may also complain to the data protection supervisor (in Belgium, the Data Protection Authority).

You may receive commercial offers from RAES PHARMACEUTICAL LOGISTICS.  If You do not (or no longer) wish to receive these, please send an e-mail to the following address: info@raeslogistics.com.
